THIS CUSTOMER AGREEMENT (the “Agreement”) is entered into by and between L&L Synergy (M) Sdn Bhd, a corporation organized under the laws of Malaysia (“L&L Synergy”), and You (“Customer” or “You”).
WHEREAS Depremium is a corporate gift-giving marketplace in the business of offering companies a variety of gifts they can purchase for employees, clients, or others; and WHEREAS the parties desire to enter into an agreement to provide these gifts; THEREFORE, the parties agree as follows:
By entering this Website, You are agreeing to Depremium’s Privacy Policy, the terms of which may be found at [https://depremium.my/privacy-policy/].
You must be at least 13 years old to access and use the Website. If you are between the ages of 13 and 18 years old, you may use and access the Website only under the supervision of your parent or guardian who has agreed to be bound by this Agreement. The customer places an order on the Depremium Website and either a) enters the Customer’s address for direct shipment or b) enters the Recipient’s email address. The Recipient can accept the Product, choose to re-gift the Product, or upgrade to another Product offered on the Website. All information you provide must be accurate, truthful, current, and complete. You accept all risks of unauthorized access and use relating to your use of the Service and will notify us promptly if you discover or suspect any unauthorized access or use.
Customer will make payment after confirming the design and placing the order, including taxes and shipping. Payments are processed by bank transfer and Depremium is not responsible for acts or omissions of the payment processing party.
By placing an order on this Website, You represent and warrant that You are 18 years or older. Depremium ships internationally but reserves the right to review and decline shipping locations that are deemed problematic. Any customs fees or return shipping fees are the responsibility of the Customer. Depremium does not guarantee the availability of a Product at the time it is ordered. Depremium does not offer refunds for “orders no longer wanted” by Customer or gifts not wanted by Recipients. Products that are damaged in transit will be replaced upon providing pictures of the damaged items. We reserve the right to request a return shipment in some cases. Customized products with the client’s logo are non-refundable. Any unredeemed eGifts may be converted to Depremium Credit for 100% of the gift value.
Customer is responsible for its conduct with respect to the gifting service or this Website. You may not modify, port, translate, or create a derivative work of the Website; decompile, reverse engineer, disassemble, attempt to derive the source code, or engage in harassment through the gifting service. Violation of this section will automatically terminate Customer’s right to use this site.
Depremium permits Customer to use its logos, labels, slogans, and captions (“Trademarks”) in the furtherance of its corporate gift-giving. Customer may not modify any Trademarks. You are not granted any rights to the Website by implication, estoppel, or other legal theory.
Depremium assumes no liability for the use or disclosure of any information or content contained herein. All Product and brand names mentioned on this Website are trademarks of their respective owners. Depremium does not endorse or recommend any particular Product on its Website. The information is provided “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. Depremium reserves the right to alter or delete any Products offered herein without notice.
Customer shall indemnify Depremium for any liability, including reasonable legal fees, for any violation of this Agreement. Customer shall hold Depremium, its subsidiaries, employees, officers, directors, and agents harmless from any and all claims, demands, or suits arising out of Customer’s actions.
DEPREMIUM IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS. DEPREMIUM’S LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID UNDER THIS AGREEMENT FOR THE PRODUCT(S) GIVING RISE TO SUCH LIABILITY.
Depremium reserves the right to suspend or terminate Your license to use this Website without notice at its discretion.
By accessing this website, You and Depremium agree that the laws and regulations of Malaysia will apply to all matters relating to Your access to this website without regard to conflict of laws principles. In the event of a dispute, You and Depremium agree to submit to the exclusive personal jurisdiction and venue of Malaysia.
This Agreement represents the entire understanding between You and Depremium. Depremium reserves the right to change the Terms of Use at any time. By accessing the Service after changes are posted, You agree to be bound by the amended terms.
This Agreement is effective as of the date You click “I Agree.”
